
Terms of delivery1. OrdersWith urgent orders and queries or if you need advice you can reach us by phone Tuesdays to Fridays between 9 am and 5 pm. At all other times our answering machine cuts in. You can also order by fax or on the Internet. These terms of delivery also apply to orders made over the phone or on the Internet. 2. Prices and terms of deliveryWith the publication of the latest catalogue all previous prices become void. Prices are valid until the catalogue is updated. We do not accept liability for any printing errors regarding pricing. For deliveries made within Germany catalogue prices include VAT at the current rate. For deliveries made to countries in the European Union (EU) VAT is charged at the current rate applicable in Germany. For deliveries to countries outside the EU we will deduct any German VAT. You will, however, then be asked to pay the usual import excise tax by the customs authorities of your country. We cannot advise you on the levying of import tax. On request we can issue your invoice with an indication of origin for all goods you have ordered. Payments made from foreign banks are only credited to our account on deduction of a € 5.00 fee. We must thus charge this to you if transfers of money are not made from a German financial institution. Orders from abroad are only processed once we have received payment. Please await our invoice requesting advance payment. Prices for books are fixed by the manufacturer. We are obliged to charge you the new price should these be altered by the publisher. 3. Shipping costs / Conditions of paymentWe charge € 7.80 towards postage and packaging with each order within Germany and € 21.00 for orders within Europe. For deliveries outside Europe we charge a standard postage and packaging fee of € 55.00. Should the parcel be heavier or larger than the norm any costs exceeding the standard fee will be charged to you. Conditions of payment:
Delivered goods remain our property until the invoice has been paid in full. 4. Delivery timesWe send out goods using the quickest service possible (letter or parcel post), usually within a few days. Please note, however, that our products are not mass-produced, thus longer delivery times are sometimes unavoidable. In such cases we can also deliver your order in part deliveries. 5. Cancellations of ordersYou can annul your contract with us without giving a reason within two weeks either in writing or by returning the ordered goods to us. The 14-day period begins at the earliest on receipt of this notice. Dispatching the cancellation or the goods being returned in due time is sufficient for compliance with the time limit for cancellation. Notice of cancellation should be sent to: Förderverein Gutenberg e.V., Gutenberg Shop, Liebfrauenplatz 5, D – 55116 Mainz, GERMANY. Consequences of cancellation: In the event of an effective cancellation any performance received by either side and any benefits derived shall be returned. If you are unable to return the performance received, or can only do so in part, or the item can only be returned in a deteriorated condition, you must compensate us for the lost value. This shall not apply to goods if the deterioration of the object is solely due to its inspection – as would have been possible in a shop. You may avoid the obligation to compensate us for the lost value by not using the object like an owner and by refraining from doing anything that may prejudice its value. When returning goods with a total order value of up to € 40.00 you must bear the costs of the return shipment if the goods delivered are as ordered. Otherwise the return shipment is free of charge. There is no right of return for audio or video recordings (e.g., CDs, DVDs, video cassettes) or software from which you have removed the seal. 6. Liability for defectsAs our products are not mass-produced minor discrepancies with the articles depicted and described in our catalogue are possible. Such deviations do not constitute a defect in the item purchased. Should a defect in goods be attributable to us you have the right to completion of contract (remedy of defects or replacement of goods).Should we not be in a position or not willing to provide completion of contract for reasons of disparity or should the completion of contract extend beyond a reasonable period for reasons which can be attributed to us or should the remedy fail in some other way, you are entitled to either demand a suitable reduction in the price of the goods or to withdraw from the contract of sale and demand damages. Unless otherwise stated below, any more extensive rights of the ordering party are precluded, regardless of the legal grounds. Therefore, we are not liable for damage that is not done to the object of delivery itself; we are specifically not liable for lost profits or other pecuniary losses you may incur. Any preclusion or limitation of our liability shall also apply to the personal liability of employees, representatives and vicarious agents. The foregoing limitation on liability shall not apply if the damage is caused by wilful misconduct or gross negligence on our part, or personal injury has been inflicted. It shall also not apply if claims under §§ 1,4 of the Product Liability Law [Produkthaftungsgesetz] are asserted. Insofar as we negligently violate a material duty under the contract, the compensation for property damage shall be limited to typically incurred damages. 7. Place of performance and place of jurisdictionOur offer is subject to change and only valid within Germany. So that your order can be processed we will make a record of your address and other data relevant to your order. We naturally pledge to treat your personal data confidentially in accordance with the stipulations made by the Federal Data Protection Law [Bundesdatenschutzgesetz]. We also guarantee not to pass on your address to any third party and to use it solely within the confines of the Gutenberg Shop. In all instances German law applies to all contracts for delivery entered into with ourselves, including those for abroad, i.e. orders and/or shipments abroad. Insofar as this may be agreed, the place of jurisdiction is the Local Court in Mainz, Germany. |
